Biotechnology Patents

A patent portfolio is often THE MOST IMPORTANT asset for a biotechnology company. U.S. Patents are granted for useful, new and nonobvious products or processes. While this appears to be a pretty big hurdle even improvements to current inventions or technologies may be patentable. In fact, a complex system may result in multiple U.S. Patents. While many inventors have a tremendous scientific ability, a patent is a legal document and should be prepared by a licensed patent attorney. Patent attorneys attended law school, are licensed attorneys and are also educated in a field of science. Patent Attorney Raymond Wagenknecht is licensed by the State of California, has a degree in Molecular Biology and is a contributing author on five (5) life science research papers. Raymond's scientific practice areas include:

  • Biotechnology & Pharmaceuticals
  • Organic Chemistry & Analytical Chemistry
  • Medical Devices
  • Nanotechnolgy
  • More...

Patent infringement occurs when an individual practices a patented biotechnology invention without the approval of the patent holder. Patent infringement lawsuits are litigated in U.S. Federal Courts and are appealed to the Court of Appeals for the Federal Circuit (in Washington, D.C.) then the Supreme Court of the United States. Patent infringement lawsuits include three (3) stages:

  • Determining the scope of the claims of a patent
  • Comparing an accused device or method to the claims &
  • Damages

Patent Attorney Raymond Wagenknecht is admitted to practice law in the Federal Court for the Southern District of California (in San Diego, California) and the Court of Appeals for the Federal Circuit (in Washington, D.C.). In addition to serving as lead counsel in a patent infringement lawsuit, Raymond may be available as a consultant for a litigation team requiring additional assistance or as local counsel for attorneys requiring a presence or assistance in San Diego, California.

Biotechnology Trademark

A Trademark indicates the source of goods. U.S. Trademark protection may be available for your biotechnology company's brand name or logo. By merely adding a "TM" or a "SM" in your everyday use, you may already be asserting your common law Trademark rights. A "TM" or "SM" may assist you in preventing others from using your Mark within your region of use. A "®" represents a federally registered trademark. There are benefits to registering a mark including evidence of ownership and access to federal courts.

Trademark Infringement occurs when an individual uses a trademark or a service mark that is confusingly similar to a valid trademark or service mark. In addition to trademark infringement, there may be additional legal causes of action like dillution of a trademark, unfair competition and others. If the trademark is a registered trademark, the trademark infringement lawsuit may be litigated in a federal court.
